Terms and Conditions

Time2Connect is provided to you by The Corporation of the Synod of the Diocese of Brisbane trading as Anglicare Southern Queensland ("Administrator"). The project is funded by the Queensland Government Department of Housing Stay Connected Fund.

The Time2Connect project includes timebanking activities supported by this platform.

To participate in Time2Connect timebanking activities, you must become a Time2Connect timebanking member ("Member") by creating a member account ("Account"). By becoming a Member and participating in Time2Connect timebanking, you agree to these terms and conditions.

These terms and conditions may change from time to time. The modified terms and conditions will be available on [t2c.timebanking.com.au] ("Website") and will apply from the date on the top of this page. If you continue to use the Website after this date, you accept the modified terms and conditions.

1. MEMBERSHIP & PARTICIPATION

1.1. It is free to create an Account and become a Member.

1.2. To be a Member, you must be:

(a) either an individual over the age of 18 or another legal entity (such as a company); and

(b) located in Queensland, Australia.

1.3. Unless otherwise permitted by the Administrator, you must not be an individual or an entity that has had an Account previously cancelled by the Administrator.

2. ACCOUNTS, USERNAMES AND PASSWORDS

2.1. Accounts

(a) To create an Account, follow the instructions on the Website at t2c.timebanking.com.au

(b) Unless otherwise authorised by the Administrator, you may only operate one Account.

(c) You must set up your Account by providing:

(i) your legal name; and

(ii) accurate and true information as required by the Account registration form.

(d) If your Account details change, you should update your Account details as soon as practicable.

(e) You accept and understand that your personal details may be displayed on the Website and shared with other Members, including your first name, surname, mobile phone number and email address.

2.2. Responsibility for Account use

You must keep your password information secure. You are responsible for all use of your Account, whether or not you have authorised it.

3. THE SERVICES

3.1 Timebanking is defined as the exchange of Services between Members using the currency of time. Timebanking does not require, nor allow for, any monetary exchange or form of bartering. Timebanking is not a marketing platform for businesses. It is not appropriate to offer services with the intention of reaping paid employment from the interaction. Services are offered and received on the understanding that all Services are of equal value and that one hour of time credit will be given or exchanged for one hour of Service received.

3.2. You may advertise and provide a variety of services using the Website ("Services"). An advertisement to provide Services is an invitation to treat and does not constitute an offer that is capable of acceptance. You and the Member requiring the Services must agree for the Services to proceed.

3.3. You should only provide Services if you are a fit and proper person to provide the Services, and reasonably believe that you have the capability, skills and necessary qualifications to provide those Services in a safe and legal manner. For example, if you have an illness or medical condition you should not undertake any activities that would adversely affect your health. You must ensure that you have all required licences and consents, relevant insurances, and comply with the law when you provide any Services.

3.4 If the Services to be provided by you involve driving you must hold a valid driver’s licence, ensure that your vehicle is roadworthy, is registered and comprehensively insured and that you follow the Queensland Road Rules at all times. If a Member receiving the Service from you asks for evidence of these matters, you should provide it to them before providing the Service. The Administrator does not conduct any checks in this regard.

3.5 You understand and accept that the Service you require may not be able to be met by the Members of the Website. You undertake the completion of Services for other Members to accumulate credits, accepting that you may not be able to redeem them for the Service you need, should that Service not be on offer from another Member.

3.6 Children are not permitted to be the direct recipients or givers of Services.

3.7. You must only use the Website to post advertisements or provide Services that are legal. You must not advertise or provide Services that:

(a) are misleading or deceptive, or make false claims or representations;

(b) promote any illegal activities; or

(c) infringe any third party right, including intellectual property, publicity, privacy or proprietary rights.

3.8. If the Administrator considers that you are making any illegal use of the Website, or providing illegal Services, it may commence legal proceedings or report the matter to the relevant law enforcement authorities. This is in addition to any other rights the Administrator has at law or under these terms and conditions.

3.9. The Administrator may remove any content posted by a Member that the Administrator considers to be harmful, threatening, unlawful, defamatory, abusive, harassing, obscene, pornographic, sexually explicit, fraudulent, hateful, or promoting racism, bigotry or harms any group or individual.

4. USE OF THE WEBSITE

4.1 You must not use the Website to:

(a) upload, post, transmit, share, store or make available by any means any content that is restricted by password or hidden from an accessible webpage;

(b) use or attempt to use another Member’s account without the Administrator’s authorisation;

(c) engage in any activities which involve unsolicited advertising or promotional materials, including junk mail, spam, chain letters, pyramid schemes, surveys, contests, sweepstakes, and mass mailing;

(d) collect usernames, email addresses or other contact information of other users by using automated scripts or other means for the purpose of sending unsolicited emails, or unauthorised linking or framing of the Website; or

(e) do anything that could damage, disable, overburden, impair or interfere with the proper operation of the Website.

5 RULES OF CONDUCT

5.1 You agree to:

(a) treat all members with respect and dignity and act with honesty and integrity at all times;

(b) respect Members’ rights to privacy and confidentiality;

(c) not pressure or harass other Members physically or verbally, in person, by phone or by email, about Services or any other matters;

(d) not use alcohol or illegal drugs before or while performing a Service.

(e) not discriminate against other Members - everyone is welcome to participate regardless of ethnicity, gender, disability, age, sexual orientation or religious and cultural beliefs

(f) only enter the home or space of other Members with their express permission.

6. TIME CREDITS

6.1. One hour spent providing Services to a Member is equivalent to one hour of time credit that can be used to receive Services from any other Member (Time Credit). The Time Credit accrued for Services is rounded to the nearest half hour. The Time Credit received for Services is not related to the market value or retail cost of those Services.

6.2 Time Credits can also be accrued:

a) by attending a group or social inclusion activity, sponsored by a Time2Connect organisation or Hub; or

b) by participating in workshops or training through the Queensland Government Housing Older Women’s Support Service.

6.3. Time Credits may only be used in accordance with these terms and conditions. There are limits on the Time Credits that can be accrued and used (see clause 8). Time Credits are transferable to other Members and to the Community Chest (see clause 7), but cannot be used for other community based exchange systems or converted to cash.

6.4. You are able to access a record of the Time Credits accrued by logging into the Website. You will be able to access basic details of the past Services provided to other Members in your personal profile on the Website.

6.5. If you have provided Services to another Member, you should record it on the Website as soon as possible. You must record the duration of your Services fairly and accurately.

6.6. An email confirmation of the Services provided, and the time claimed, will then be sent to the Member who has received your Services.

6.7. The Administrator may request further information from Members about any of the Services provided, e.g. to determine whether Time Credits have been validly earned and accrued. You must promptly comply with any such request for information.

7. DONATION OF TIME CREDITS TO THE COMMUNITY CHEST

7.1. You may donate any or all Time Credits that you have earned to the Community Chest.

7.2. If you agree to donate Time Credits to the Community Chest, you acknowledge and agree that:

(a) Time Credits donated to the Community Chest cannot be retracted or withdrawn once they have been donated;

(b) you cannot donate more Time Credits than you have accrued; and

(c) Time Credits donated to the Community Chest may be used as the Administrator sees fit (including re-allocating them to other Members). You cannot direct how Time Credits that are donated will be dealt with by the Administrator. You may however gift your Time Credits to any other Member.

8. TIME CREDIT LIMITS

8.1. All Members start with a zero Time Credit balance. Members may begin to receive Services straight away without having accrued any Time Credits. However your Account must never be more than 8 hours in deficit. The Member that provides the Services to you will still accrue Time Credits for the Services provided to you.

8.2. If you accrue 60 hours or more in Time Credits, you must reduce your Time Credits to under 60 hours by:

(a) using the Time Credits to receive Services; or

(b) donating the Time Credits to other Members or the Community Chest.

8.3. The Administrator may by notice to you take steps to enforce the limits set out in this clause 8, including by cancelling your Account, or donating or cancelling your Time Credits that are over the allowable limits.

9. INACTIVE ACCOUNTS

9.1. If there has been no activity on your Account for a period of 12 months or more, the Account will be considered to be inactive. The Administrator may, by email notice to you, cancel your Account and any Time Credits you have will be forfeited.

If you still wish to participate in Time2connect timebanking, you will need to set up a new Account. You will not be able to recover the Time Credits from your previous Account.

10. CANCELLING ACCOUNTS

10.1. You may request cancellation of your Account by contacting the Administrator by email. The Administrator will cancel your Account as soon as practicable. Any Time Credits you have will be forfeited and you will no longer be able to log into your Account.

10.2. The Administrator may, without limiting its rights, suspend or cancel your Account:

(a) for any reason by sending you an email notifying you of the suspension or cancellation; or

(b) without notice, if you commit a serious breach of any of these terms and conditions; or

(c) on at least 14 days’ notice by email, if you commit a breach (other than a serious breach) of any of these terms and conditions.

10.3 If your Account is suspended for any reason, you will still be able to access your Account but you will not be able to accumulate or use your accrued Time Credits.

10.4. If your Account is cancelled for any reason, you will not be able to access your Account details and you will forfeit all Time Credits.

11. GENERAL ADMINISTRATOR RIGHTS

11.1. In addition to the Administrator’s other rights under these terms and conditions, the Administrator may at any time for any reason:

(a) suspend your use of the Website;

(b) cancel any or all the services and functionality offered on the Website;

(c) make modifications to your Account and Time Credits balance;

(d) remove or modify any content, including advertisements, that you post on the Website;

(e) block access to all or any part of the Website; or

(f) decide to no longer offer Time2Connect timebanking, in which case the Administrator will provide Members with at least 1 month’s prior notice.

12. PRIVACY

12.1. The Administrator collects personal information, including sensitive information, from you to enable you to participate in Time2Connect.

12.2. The primary purpose of collecting your information is to enable you to create an Account and participate in Time2Connect by providing and receiving Services from other Members.

12.3 The Administrator collects, uses, holds and discloses personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

12.4 If you don’t provide your personal information to the Administrator it will not be possible for you to create an Account and participate in Time2Connect.

12.5 When you create an Account your personal information will be displayed on the Website and shared with other Members. This personal information may include your first name, surname, mobile number and/or email address.

12.6 Personal information may be disclosed to the Administrator’s contracted service providers including the Website’s hosting and support provider as well as to others for funding and administrative purposes.

12.7 From time to time, the Administrator may contact you about its services, advocacy programs and fundraising opportunities. The Administrator will engage in marketing unless you tell the Administrator otherwise. You can choose to opt-out at any time by contacting the Administrator or by clicking the unsubscribe link at the base of the marketing material.

12.8 The Administrator’s Privacy Policy deals with your right to access and correct personal information that the Administrator holds about you as well as how you can make a complaint if you believe that the Administrator has breached the APPs. Your point of contact is the Anglicare Southern Queensland Privacy Officer.

13. DISCLAIMERS

13.1. You acknowledge that the Administrator may, but is under no obligation whatsoever to, monitor the Website (including any content and any advertisements posted by Members). The Administrator makes no promises or representations in relation to the type, skill, qualifications, expertise or availability of persons that become Members, nor the Services or advertisements provided by them, including as to their legality, truth, accuracy, or suitability.

13.2. You must exercise care and caution when interacting with people you do not know. You take full responsibility for participating in Time2Connect (including using the Website, and receiving Services from and providing Services to other Members), and do so solely at your own risk.

13.3 The Administrator is not responsible or liable in any manner for:

(a) the accuracy, truth, appropriateness, completeness of any content posted by Members on the Website, including content in breach of clause 3, that you may be exposed to while using the Website;

(b) any Member’s online or offline conduct, including activities that are in breach of clause 3 and 4;

(c) the deletion and removal of your content (including advertisements);

(d) any errors that may be in the Website content or the accrual or use of Time Credits;

(e) any delay, suspension or cancellation of the Website to you (including your Account);

(f) your content, the Website being error-free, defect-free or free from interruption, external intruders (hackers), virus or worm attacks, denial of service attacks, and persons having unauthorised access to the Website or Time2Connect systems; or

(g) the Services advertised by Members, including the nature, quality or suitability of the Services advertised.

13.4. Any information provided on the Website (including any content and any advertisements posted by Members) is for information only and is not intended, and should not be taken or relied on, as advice. Unless expressly stated by the Administrator, the Administrator does not recommend or endorse any views, opinions, advice, recommendations (including any content and any advertisements posted by Members) on the Website.

14. LIABILITY

14.1. The Administrator accepts no liability for any loss, liability, damages, expenses, costs or charges of any kind whether arising in tort (including negligence), equity or otherwise which you suffer or incur arising from or in connection with your participation in Time2Connect (including your use of the Website, and the Services you receive from and provide to other Members).

14.2. Any representation, warranty, condition or undertaking that would be imposed by legislation, common law, equity, trade, custom or usage is excluded to the maximum extent allowed by law.

15. INDEMNITY

15.1. You indemnify the Administrator (including its officers and employees) from any loss, liability, damages, expenses, costs (including legal costs) or charges of any kind (Loss) which the Administrator (including its officers and employees) suffers or incurs arising from or in connection with your participation in Time2Connect (including your use of the Website, and the Services you receive from and provide to other Members), except to the extent that the Loss was caused by the negligent act or omission of the Administrator.

16. TAX IMPLICATIONS

16.1. You are responsible and liable for any tax or other liabilities incurred in relation to Services you provide to or receive from other Members. The Administrator makes no warranties or representations that it has examined the tax implications of any transaction that a Member may enter into and does not provide advice or recommendations of any kind. We recommend that you obtain your own advice from a qualified professional.

17. DISPUTES

17.1. If any dispute arises between Members they should attempt to resolve the dispute between themselves. If the dispute is not resolved between the Members, the dispute may be referred to the Administrator for mediation. If the dispute involves the Administrator, matters may be escalated to the Director, Mission, Research and Advocacy, Anglicare Southern Queensland, contactable at 1300 610 610.

18. GENERAL

18.1. These terms and conditions do not create any employment, partnership, joint venture, fiduciary or other relationship between the Administrator and any Member.

18.2. These terms and conditions are governed by the laws of Queensland, Australia.
